This End-User Licence Agreement ("Agreement") is between you and ADH Digital ("we", "us", "the Developer"), not with Apple Inc. ("Apple"). By downloading, installing, or using CipherRank ("the App"), you agree to the following terms.
CipherRank is an educational app for CompTIA certification exam preparation, currently covering Security+ (SY0-701), Network+ (N10-009), and CompTIA SecAI+ (CY0-001). It is a study aid and does not guarantee exam results, certification, or employment outcomes.
We grant you a limited, non-exclusive, non-transferable licence to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The App may also be accessed by other accounts associated with you via Family Sharing or volume purchasing.
CipherRank offers per-track paid subscriptions that auto-renew monthly unless cancelled at least 24 hours before the billing period ends. All purchases are processed by Apple. Manage or cancel in Settings > [Your Name] > Subscriptions.
All mission content is original and curated by the developer.
You agree not to reverse-engineer the App, redistribute its content, use automated tools to interact with the App or its server, or circumvent rate limits or access controls. You must also comply with any applicable third-party terms of agreement when using the App, including the terms of your wireless data service provider.
All content, design, and code are the property of ADH Digital or used under license. CompTIA, Security+, Network+, and CompTIA SecAI+ are trademarks of CompTIA, Inc. CipherRank is not affiliated with or endorsed by CompTIA.
You acknowledge that in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, ADH Digital — not Apple — will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
ADH Digital is solely responsible for providing maintenance and support for the App. You acknowledge that Apple has no obligation to provide any maintenance or support services for the App.
The App is provided "as is". ADH Digital disclaims all warranties to the maximum extent permitted by applicable law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to a warranty are the sole responsibility of ADH Digital.
To the maximum extent permitted by law, ADH Digital is not liable for indirect, incidental, special, or consequential damages arising from your use of the App. You acknowledge that ADH Digital, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your use of the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement. Upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
We may update these terms. Continued use after changes constitutes acceptance.
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada.
